Unless otherwise specified, all materials appearing on this site, including newsletter articles, surrounding text, site design, logos, graphics, icons, and images, as well as the selection, assembly, and arrangement thereof, are the sole property of Wisemind Academy. All audio and video clips are the property of Wisemind Academy, or its respective content providers. All software used on the site is the sole property of Wisemind Academy or those supplying the software. No materials from this site may be copied, reproduced, modified, republished, uploaded, posted, transmitted, or distributed in any form or by any means without prior written permission from Wisemind Academy. All rights not expressly granted herein are reserved. Unauthorised use of the materials appearing on this site may violate copyright, trademark, and other applicable laws and could result in criminal or civil penalties.

1. General Terms

The use of this site is governed by the policies, terms, and conditions set forth below. Read these terms carefully before you access the following website (the “Site”). By accessing the Site, you indicate that you agree with and are bound by the terms below. Individual documents and parts of the Site may include special terms to be applied in addition to these terms. The use of the Solo Service is governed by special service agreement terms.

Wisemind Academy does not make any warranties about the Site or its contents. We reserve the right to update the Site and to discontinue access to the Site at any time. Wisemind Academy shall not be liable for any expenses, losses, or damages arising out of the use of the Site even if Wisemind Academy or its representative had known about a defect in the service.

2. Ownership

The Practice Tests are property of Wisemind Academy and are licensed to you under the terms of the licence agreement printed herein (“Agreement”). By accessing the practice test, you acknowledge that you have read this agreement, that you understand it, and that you agree to be bound by the terms and conditions of this agreement.

3. Scope of Rights Licensed

Wisemind Academy is granting you a limited, non-exclusive, non-transferable licence to use the Practice Test, in part or in whole, for your internal business or personal use. Any internal or personal use of the Practice Test content must be accompanied by the phrase “Used with permission from Practice Tests Academy” or other phrasing agreed upon in writing by Wisemind Academy.

4. License Sharing

This licence is being granted to only the purchaser of the practice test. Excessive use, which shall be judged solely at the discretion of Wisemind Academy during the licence period that may be indicative of licence sharing, may result in the licence being revoked with no refund or recourse. Wisemind Academy will investigate excessive usage prior to any licence revocation.

5. Restrictions on Transfer

Reproduction or disclosure in whole or in part to parties other than Wisemind Academy’s client that is the original subscriber to this Practice Test is permitted only with the written and express consent of Wisemind Academy. This Practice Test shall be treated at all times as a confidential and proprietary document for internal use only.

Any purported sale, assignment, transfer, or sublicence without the prior written consent of Wisemind Academy will be void and will automatically terminate the Licence granted hereunder.

6. Limited Warranty

The information contained in this practice test is believed to be reliable but cannot be guaranteed to be correct or complete. If the Practice Test’s electronic delivery format is defective, Wisemind Academy will replace it at no charge if Wisemind Academy is notified of the defective formatting within 30 days from the date of the original download or receipt of Practice Test.

7. Limitation of Liability

In no event will Wisemind Academy be liable to you for any damages, including, without limitation, any lost profits, lost savings, or other incidental or consequential damages arising out of your use or inability to use the practice test regardless of whether such damages are foreseeable or whether such damages are deemed to result from the failure or inadequacy of any exclusive or other remedy. In any event, the liability of Wisemind Academy shall not exceed the licence fee paid by you to Wisemind Academy.

8. Disclaimer and Limitation of Liability as to Products Sold

Except as expressly stated herein, Wisemind Academy makes no representations or warranties, either express or implied, of any kind with respect to products sold on the Site. Except as expressly stated herein, Wisemind Academy expressly disclaims all warranties, express or implied, of any kind with respect to products sold on this Site, including, but not limited to, merchantability and fitness for a particular purpose. You agree that the sole and exclusive maximum liability of Wisemind Academy arising from any product sold on the Site shall be the price of the product ordered. In no event shall Wisemind Academy or its representatives be liable for special, indirect, consequential, or punitive damages related to product sold.

9. Pass Assurance and Money Back Guarantee

Wisemind Academy provides additional features to its online products, such as Pass Assurance (you used our tool but still failed your exam, you are entitled to have your access extended) and the 7-Day Money Back Guarantee (if for some reason you don’t appreciate the quality of our product, you are entitled to claim your money back within 7 days of your purchase). 10. Sales Taxes

Each customer shall be solely responsible for any sales taxes, value-added taxes, customs duties, or other taxes payable in their own jurisdiction in connection with their purchase. Prices shown on the Site are inclusive of any taxes that may be applicable to Wisemind Academy.

Wisemind Academy is a Swiss sole proprietorship and is not currently registered for Swiss VAT. As such, Swiss VAT is not charged on, and cannot be reclaimed in respect of, purchases made from the Site. If your accounting or employer requires a standard sales receipt for your purchase, please contact us and we will be happy to provide one.

11. Jurisdiction and Venue

These Terms and Conditions, and any contract formed between you and Wisemind Academy in connection with the Site, are governed by the substantive laws of Switzerland, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG) and to the exclusion of any conflict-of-law rules that would lead to the application of any other law.

You agree that the sole jurisdiction and venue for any dispute arising out of or in connection with your use of, or orders made on, the Site shall be the competent courts of the canton of Vaud, Switzerland, subject to any mandatory consumer-protection rules of your country of residence which entitle you to bring proceedings in another forum.

12. Fair Usage Policy for Tutor Support

We offer an “Ask a Tutor” feature to assist with specific questions related to our content. To ensure fair usage of this feature, please adhere to the following guidelines:

• Each user is limited to a maximum of 20 questions per month.
• Questions must be directly related to our question bank, videos, or summary notes.
• Personal tutor support is available only for Ultimate plans where a dedicated tutor is assigned.
• If users exceed the question limit or ask irrelevant questions, a warning will be issued. Continued abuse may result in withdrawal of tutor support.
• Our tutors are here to assist with relevant content-related questions, and we need to protect their time and resources to provide quality support to all users.
